Although privacy is a well-recognized and core component of Principle E (Respect for People’s Rights and Dignity) of the APA Code of Ethics, the geropsychology practice context has many unique facets that complicate application of privacy and information confidentiality practices. Practicing in long-term care settings in particular requires complying with stringent professional and regulatory privacy standards which, when combined with working with multiple stakeholders, organizational dynamics, mandatory reporting, and other contextual factors can create difficult ethical and practical challenges.
This presentation explores privacy practices and maintaining confidentiality in the context of treating older adults, including documentation processes, Medicare and HIPAA requirements, and mandatory reporting imperatives (e.g., Tarasoff). Special emphasis is placed on what information “may” be shared versus what information “shall” be shared to relevant parties.
